党内法规实施效果评估程序问题研究

摘　　要：党内法规实施效果评估是构建科学完善的党内法规的主要环节,也是近几年来理论上研究的薄弱环节。当前理论研究的主要成果集中在党内法规的实体性问题上,有关党内法规程序性研究成果不多。文章从分析党内法规实施效果评估程序设计基础问题入手,提出我国党内法规实施效果评估程序设计的参与主体多元化原则、透明性原则和程序理性原则,并在此基础上初步勾画出我国党内法规实施效果评估的程序架构。The evaluation of the implementation effect of inner-party laws and regulations is the main link in the construction of scientific and perfect inner-party laws and regulations,as well as the weak link of theoretical research in recent years.At present,the main achievements of theoretical research are focused on the substantive issues of the inner-party laws and regulations,while there are few achievements on the procedural aspects of the inner-party laws and regulations.Starting from the analysis of the basic problems of the procedure design for the evaluation of the implementation effect of the inner-party laws and regulations,this paper puts forward three guiding principles of the procedure design of the evaluation of the implementation effect of the inner-party laws and regulations in our country,including the principle of pluralism,the principle of transparency,and the principle of procedural rationality.On this basis,the article initially ortlines the procedural framework of the evaluation of the implementation effect of the laws and regulations within the party.
