音乐产权概念及其特征探析

摘　　要：一般产权含义存在争议但多被视为经济权。音乐产权概念是一个组合术语,有自己词源,虽无统一定义,但立法实践界定了音乐产权内涵。音乐产权是音乐权人对其音乐表达形式的利益或者保有利益的资格。音乐权人、音乐表现形式、使用、社会行为准则、内容是音乐产权概念包含的要素。相较于其他权利,音乐产权具有使用权、选择权、期待权和权利束的特性。界定音乐产权概念及其特征,对完善音乐产权制度有时代性意义。The general meaning of property right is controversial but often regarded as an economic right.The concept of music property right is a combined term with its own etymology.Although there is no agreed definition,the connotation of music property right is defined by legislation.Music property right is music right holder’s interest or the qualification of keeping interest to his music expression forms.The music right-holder,music form of expression,usage,social behavior criterion and content are elements included in the concept of music property.Compared with other rights,music property right is characterized by the right to use,right to expect,right to choose,and a cluster of rights.Defining the concept and characteristics of music property right is of great significance to perfecting the system of music property right.
