大学公权力:概念、溯源与治理——基于国家监察治理的视角

摘　　要：大学公权力是基于公权视角对大学场域各类权力的审视。在不同学科的语境下,大学存在不同的权力谱系与权力来源。大学场域的公权力包括国家公权力、社会公权力和国际公权力。大学公权力是国家公权力的让渡与赋权,是大学作为公共组织行使的、能影响师生与社会公众权利义务的能力,主要是指大学的社会公权力。大学本应是传播高尚文化的清廉净土、社会文明的灯塔,但商业文明催生的利己主义、拜金主义不断侵蚀着校园。在权力机制作用下,大学公权力的腐败寻租具有一定的隐蔽性和破坏性。大学公权力治理的关键是加强大学自身的治理体系与治理能力建设,积极推进大学公权力治理与完善国家监察体系相结合以及大学公权力治理与大学学术治理相结合。依法界定国家监察与大学内部治理的边界,既要防止出现监察盲区,又要避免国家监察权越位滥用。这需要加强学术自律,防止学术权力的寻租与腐败;深化政府"放管服"改革,遵从大学的学术逻辑与学术规律,回归学术本位。Public power in a university indicates all kinds of power within a university reviewed from the perspective of public power. In the context of different disciplines,a university has different types of power from different sources. Its public power,which includes national,social,and international public power,gets assigned through national public power,reflects the power(mainly including the social public power)exercised by a university as a public institution,and shows its ability to affect the rights and duties of teachers,students and the public. A university should have been a pure land spreading noble culture,or a lighthouse disseminating social civilization,but it is unceasingly corroded by the commercial civilization-driven egotism and money worship. Affected by the power mechanism, corruption and rent-seeking in a university’s public power is concealed and destructive to some extent. The key to the governance of a university’s public power is to strengthen its system and capability for governance,and promote the combination of its public power governance with both the consummation of the system for national supervision and its academic governance.We need to clarify the boundaries between national supervision and a university’s internal governance in accordance with the law,but we must prevent blind spots in national supervision and avoid abusing it. This entails more efforts on academic self-discipline to prevent corruption and rent-seeking in academic power, and the deepening of the government’s reform through innovative supervision during decentralization and high-efficiency services to let a university return to academic standards by following academic logic and laws.
