论农村环境治理的工具创新:以环境效益债券为例

摘　　要：中国农村环境治理经历了政府单一治理到引入市场工具实现多元主体治理的变迁,但当前仍以政府管控下的"命令—控制"模式为主。政府管控下的农村环境治理存在治理资金不足,市场、社会主体与社区自治主体参与不足,治理主体权责配置不清和监督考核机制缺位等问题。在此背景下,环境效益债券被认为能够作为我国农村环境治理的工具创新,其将社会资本引入农村环境治理,政府为农村环境治理的可验证结果付费,政府、市场、社会主体等协同参与推进农村环境治理。分析发现,环境效益债券应用于我国农村环境治理的技术逻辑、实践逻辑及法律逻辑均能内恰,当下需加快厘清环境效益债券应用的挑战并对应进行制度供给。China’s rural environmental governance has undergone a change from the single government governance to the introduction of market tools to achieve multi-subject governance,but at present it is still dominated by the"command and control"mode under government control.In rural environmental governance under government control,there are many difficulties,such as insufficient funds for governance,insufficient participation of market,social subjects and community self-governance subjects,unclear allocation of powers and responsibilities among governance subjects,and absence of supervision and assessment mechanism.In this context,environmental impact bond is considered as a tool innovation for rural environmental governance in China.It introduces social capital into rural environmental governance,the government pays for success of rural environmental governance,and the government,market and social subjects participate in promoting rural environmental governance in a coordinated way.It is found that the technical logic,practical logic and legal logic of the application of environmental impact bond in China’s rural environmental governance are all within the right,and it is necessary to accelerate the clarification of the challenges of the application of environmental impact bond and corresponding system supply.
