摘　　要：意定监护制度的建立弥补了我国成年监护制度的不足,是“自我决定权”的制度化体现,也是关心人、尊重人的现代民生价值观的具体体现。由于我国意定监护制度的基本框架设计比较粗略>在实施过程中已反映出监护人职责范围不清、监护效力不高及监护的撤销与监护监督机制缺失、适用对象范围过窄等问题。应结合我国国情细化监护人职责,以菜单式监护职责指引监护人,区分财产和人身监护;明确指定监护,推动意定监护效力优化;设置多个监护人,并设立监护顺位,以防止监护资格撤销导致监护目的落空;在考虑监护权的存续和转移问题基础上解除监护合同。The establishment of the voluntary guardianship system makes up for the deficiency of the adult guardianship system in China.It is the institutionalization of"self-determination"and the embodiment of modern values of caring for and respecting other people.Since the basic framework design of the voluntary guardianship system in China is relatively rough,some problems have been exposed in the implementation process,such as the unclear scope and low effectiveness of guardianship,the lack of a mechanism for the revocation and supervision of guardianship,and the narrow applicable areas.We should refine the duties of the guardians according to the conditions of our country guide the guardians with an menu-type duty list,and distinguish between property and personal guardianships;clarify designated guardianship to optimize the effectiveness of voluntary guardianship;and nominate multiple guardians and determine the guardianship order so as to avoid failing to obtain the goal of guardianship due to revocation of the guardianship qualification;and take into account the survival and transfer of guardianship when terminating the guardianship contract.
