外层空间反卫星武器法律规制研究

摘　　要：近年来,对于外层空间的探索利用,存在从强调合作的全球主义转向强调冲突的空间民族主义的趋势。外空局势波诡云谲,不仅体现初见端倪的关于外空资源等经济利益的争夺,更体现在军事领域中以反卫星武器试验为典型的外空武器化趋势与军备竞赛。数量剧增的空间碎片已经成为影响航天器寿命与安全的最重要因素之一,空间碎片减缓和清除已刻不容缓。但反卫星武器的使用却将进一步恶化外空环境,对全人类和平开发、利用和探索外空产生负面影响。以外层空间法"和平利用外空原则"、“保护外空环境原则”和武装冲突法“区分原则”、“比例原则”、“限制原则”为依据并结合实践视角,指出对反卫星武器加以规制的必要性与正当性。In recent years,the exploration and utilization of outer space has shifted from globalism that emphasizes cooperation to space nationalism that emphasizes conflict.The volatility of the outer space situation not only reflects the initial struggle for economic interests such as outer space resources,but also reflects the weaponization trend and arms race in outer space typical of anti-satellite weapon tests in the military field.The dramatic increase in space debris has become one of the most important factors affecting the life and safety of spacecraft,and the mitigation and removal of space debris is of urgency.However,the use of anti-satellite weapons will further deteriorate the outer space environment and have a negative impact on the peaceful development,utilization and exploration of outer space for all mankind.Based on the"Principles of Peaceful Use of Outer Space","Principles of Protecting the Environment of Outer Space"and the"Principles of Distinction","Principles of Proportionality","Principles of Restrictions"in the Law of Armed Conflict,combined with practical perspectives,to point out the necessity and legitimacy of regulating anti-satellite weapons.
