维护全国人民代表大会的民主功能——兼评《全国人大组织法》(修正草案)

摘　　要：现行宪法通过扩大全国人大常委会职权实现了全国人大制度功能上的调试,即民主代议与有效决策的适度区隔。全国人大的首要功能在于表达民意、汇集民智。在实践中,全国人大的民主功能却同时呈现发挥不足与负荷过重两方面的问题。《全国人大组织法》的修改应当严格遵循宪法初衷,充分维护全国人大的民主功能。The P.R.C Constitution,by empowering the National People’s Congress Standing Committee,has actually realized functional divergence of the NPC.The NPC’s prime function is democratic representation,while the NPCSC is more efficiency-oriented.The primary function of the NPC is to express public opinion and gather the wisdom of the people.Nevertheless,the NPC’s democratic function is both under-performed and over-burdened.The revision of the Organic Law of the NPC shall fully reflect the original intent of the Constitutional framers by safeguarding the democratic function of the NPC.
