我国竞争法竞争观的理论反思与制度调适——以屏蔽视频广告案为例

摘　　要：竞争法竞争观的确定微观上关乎具体竞争行为正当性的认定结果,中观上决定竞争法的权益配置,宏观上折射竞争法的法律定位与发展走向,是竞争法研究的基础命题。受竞争法脱胎于侵权行为法的历史渊源、不正当竞争案件审理法官的知识前见与审理路径依赖、竞争法立法目的条款表述之影响,传统竞争法采用静态竞争观。然而,基于经济层面市场动态竞争的本质规律、利益层面消费者利益角色革新引致法益结构变革、法律属性层面竞争法逐渐浓厚的社会法品格及作为行为规制法的功能驱使,竞争法应植入动态竞争观。为贯彻之,需要引入比例原则为分析工具,兼顾道德判断与经济效果分析,在还原竞争场景的基础上综合考量多元因素。The competition concept of competition law is not only related to the legitimacy of competition behavior,but also determines the allocation of rights and interests of competition law.Besides,it also reflects the legal positioning and development trend of competition law which is the basic proposition.Affected by the historical origin of competition law deriving from tort law,judges'knowledge preference in unfair competition cases,trial path dependence,and the expression of legislative purpose clauses of competition law,traditional competition law adopts static competition concept.However,based on the essential laws of market dynamic competition at economic level,the reform of consumer interest role which leads to legal benefit structure’s reform at interest level,and the increasingly strong social law character of the competition law at the legal attribute level,as well as the function driven by the behavior regulation law,it is proved that competition law should adopt dynamic competition concept.In order to implement it,the principle of proportionality needs to be implanted as an analytical tool,moral analysis and economic analysis need to be considered,and multiple factors need to be considered under the recovery of competitive scenarios.
