摘  要:随着国家鼓励大学生创新创业计划的推进,在校大学生兼职劳动群体不断壮大。然而,我国现行劳动法律规范体系将在校大学生兼职劳动排除在其调整对象之外,在校大学生劳动者法律地位不明确,在校大学生与用工方之间的劳动关系法律性质不清晰,在校大学生兼职劳动的合法权益得不到法律的有效保护。应将在校大学生的兼职劳动关系纳入国家就业促进政策的主流框架,并通过对现行劳动法和社会保障法的立法改造,构建安全性与灵活性兼具的弹性保障机制,保护在校大学生兼职劳动权益的实现。With the promotion of the national plan to encourage college students to start their own businesses,the part-time labor group of college students has been growing.However,China's current labor legal standard system excludes part-time labor of college students from its adjustment objects,the legal status of college students is not clear,the legal nature of the labor relationship between college students and employers is not clear,and the legitimate rights and interests of part-time labor of college students cannot be effectively protected by law.The part-time labor relationship of college students should be brought into the mainstream framework of the national employment promotion policy,and through the legislative reform of the current labor law and social security law,a flexible security mechanism with both safety and flexibility should be built to protect the realization of the part-time labor rights and interests of college students.
