摘  要:互联网时代竞争法应采用何种模式保障消费者利益是竞争法研究的基础问题,也是一个极富时代属性的回应型问题,还是验证本次《反不正当竞争法》修订是否科学的重要指标。受反不正当竞争法最初立法动因、特定经济社会发展阶段特点及立法技术之影响,该法以反射方式保障消费者利益。然基于经济层面互联网商业模式谱写消费者主权,实践层面经营者利益与消费者利益冲突升级,观念层面消费者整体权利意识锐进以及为回应消费者整体利益诉求,证成反不正当竞争法应直接保护消费者利益,并从权益主体、权益内容及权益救济三维度构建反不正当竞争法的消费者利益保护体系。The issue that what model competition law should adopt to protect consumers’ interests during age of internet is a basic issue of competition law as well as a look-forward proposition, and act as an important indicator to verify whether the amendment of anti-unfair competition law is scientific. Influenced by the initial legislative motivation and characteristics of specific economic development stages as well as legislative technique, anti-unfair competition law protects consumers’ interests reflectively. Considering that the internet business model composes consumer sovereignty at economic level, the conflict between operators’ interests and consumers’ interests escalates at practical level, overall consumers have a keen awareness of their rights at interests level and respond to consumers’ demands at concepts level, we get the conclusion anti-unfair competition law should adopt direct model to protect consumers’ interests. In addition, we can construct consumers’ interests’ protection system in anti-unfair competition law from three aspects including subject, content and relief.
