物的所有权人与无权占有人间的次要返还请求权探析

摘　　要：物的所有权人与无权占有人间的法律关系又称"物的回复人与占有人的关系"或"回复请求人与占有人的权利义务关系",主要涵括物的所有权人与无权占有人间的返还请求权及前者请求后者返还孳息、赔偿损害与后者请求前者偿还费用等次要返还请求权。我国《民法典》物权编对物的所有权人与无权占有人间的请求返还孳息、赔偿损害和偿还费用等的厘定(规定)应透过解释而予适用。另外,对于物的所有权人与无权占有人间的次要返还请求权的学理与法理,我国也宜根据近现代与当代域(境)外的学理、法理及立法成例予以解释,期冀其可为我国《民法典》物权编中的物的所有权人与无权占有人间的法律关系制度及其规则的适用提供支撑或注释论("评注论""解释论")的导引。The legal relationship between the owner of the property and the unauthorized possessor is also called"the legal relationship between the restorer of the property and the possessor"or"the relationship of rights and obligations between the respondent and the possessor",which mainly includes the restitution claim between the owner and the unauthorized possessor,and the former requests the latter to return the fruits,compensate for damage and the latter requests the former to pay the expenses back.The definition and stipulation of claim for return fruits,compensation for damages and payment expense between the owner and the unauthorized possessor in the property volume of China’s Civil Code should be applied through interpretation.In addition,with regard to the academic theory and legal principles of the subordinate claim for return fruits,compensation for damages and pay expenses between the owner and the unauthorized possessor in China,China should also explain it according to the modern and contemporary academic theory,legal theory and legislative precedent,so as to provide the support or the guidance of annotation theory(commentary theory or interpretation theory)for the application of these systems and rules in property volume of China’s Civil Code.
