摘 要:随着生态文明建设的日益民主化和现代化,环境公众参与由环境法基本原则逐渐上升为宪法原则。环境公众参与的规范形式在法国经历了环境单行法原则、环境法典总则原则和宪法原则三个阶段。宪法化的环境公众参与原则与程序性环境权建立关联,充当着宪法审查依据。宪法委员会据此建立相应的审查标准,倒逼环境公众参与机制的完善,提升了生态文明建设的效率和民主程度。我国的环境公众参与正处于单行法原则的阶段,未来的环境法典编纂有必要注重环境公众参与原则的规范形式和制度建构,并从宪法和宪法审查层面前瞻性地考虑环境公众参与的地位。With the democratization and modernization of ecological civilization,environmental public participation gradually upgrades from basic principle of environmental law to constitutional principle.In France,the normative form of environmental public participation went through three phases:single environmental statute principle,environmental code principle and constitutional principle.The constitutionalized environmental participation principle,combined with procedural right of environment,functioned as the constitutional review criterion.The Constitutional Council established certain case law system,compelling the perfection of public participation regime,and promoting the efficiency and democratization of ecological civilization.Environmental public participation in Chinese law is in the stage of single statute principle.The coming codification of environmental law should pay attention to the normative form and regime construction of public participation.It’s also necessary to consider the role of public participation in the level of constitutional law and constitutional review.
