当下纪法衔接机制的进步、不足与完善--以监督执纪“四种形态”与刑事司法的衔接为视角

摘　　要：在我国监察体制改革进入新阶段的大背景下,随着相关法律法规包括党内法规的修改完善和实践的推进,一方面,“纪法衔接”机制发展有了新进步,即纪律和法律衔接在内容具体规定上的完善以及实践操作上的有益探索;另一方面,“纪法衔接”机制面临新问题,具体包括政治话语进入法律体系带来的理解、适用问题,以及形态转化畸宽导致出现执纪非罪化趋势问题。政治话语转化为法律话语的问题,核心在于解构法律话语所具有的特征来改造政治话语;而对于“四种形态”中“四转三”形态转化畸宽、带来刑事犯罪的非罪化趋势的问题,需要从制定操作细则、完善转化程序两方面入手解决,执行层面可以考虑探索引入司法监督等外部监督力量的参与。Under the background of the supervisory system reform entering a new stage in our country,with the modification of relevant laws and regulations,and the development of practice,on the one hand,discipline-law cohesive mechanism has a new progress which are new relevant rules on specific content and helpful exploration in practice.However,on the other hand,the mechanism confronts new problems which include the understanding and application of political discourse into the legal system and the trend of enforcement and decriminalization caused by the abnormal form transformation.In view of these two problems,commission for discipline inspection is supposed to consider the two ways of transforming political discourse into legal discourse,formulating operating rules and perfecting transformation procedures.
