摘　　要："一带一路"背景下研究我国少数民族传统医药知识产权保护具有重大战略意义。本文针对内蒙古地区蒙医药龙头科研单位及企业的专利行为特点进行研究,以期改善蒙医药科研院校及企业的专利行为提供新的启示。根据蒙药专业排名及已进入国家基本药物生产企业目录,选择内蒙古地区的三所大学院校及其两家附属医院、五家蒙药企业,以中国知识产权网为检索源,通过检索"申请(专利权)人",实证研究其在1985-2015年的专利申请数量、专利申请类型、国际专利分类以及法律状态等专利行为。结果显示,10家蒙医药单位的专利申请数量总体呈现不断增长趋势,尤其,自2013年起,三家蒙药大学院校的专利申请显著升高,其中,发明专利的申请比例较高,已授权专利较多并有良好的专利维持现象;申请专利技术领域集中于化合物或组合物及其制备方法相关的技术主题。结果表明蒙医药专利保护实证行为有较强的政策依赖性,建议在"一带一路"倡议新构思及其他相关政策的扶持及鼓励下蒙药企业及科研单位抓好发展契机,进一步提高科研水平的同时注重传统医药知识产权的保护。It has a great significance strategy that protecting the intellectual property of traditional Chinese medicine of ethnic minorities under the background of"The Belt and Road Initiative".To study the characteristics of patent behaviors of mongolian pharmaceutical demonstration enterprises for intellectual property,and to provide reference for the improvement of patent behaviors in mongolian pharmaceutical enterprises,ten pharmaceutical demonstration enterprises chosen through ranking of major in mongolian medicine and the directory of national essential drug production enterprise as the study samples after retrieving the applicants(patentees)from China Intellectual Property Right Net which was conducted on their patent behaviors from 1985 to 2015,including the number and type of the patents for which applications were made,international patent classification and legal status.The results indicated that the number of patent applications of the ten pharmaceutical demonstration enterprises demonstrated a growing trend,which were dominated by the inventive patent and many patents were in authorized legal status,whose enterprises paid more attention to the maintenance of the authorized patent.In addition,the patent applications were mainly about composition,or preparation methods,including the technical proposal containing the active ingredients and properties of the pharmaceutical preparation(A61K),particularly the application of the technical proposal related to the treatment with the preparation(A61P).It is suggested that all the ten mongolian pharmaceutical demonstration enterprises have stronger policy dependence and they can enhance their competitiveness and creativity through adjusting patent behaviors and increasing their awareness of patent competition.
