危险货物包装标准义务违反的刑事责任思考——以“7·22”特别重大卧铺客车燃烧事故案为例

摘　　要：以“7•22”河南信阳特别重大卧铺客车燃烧事故案为例,分析了危险货物运输包装标准赋予了从业人员特别注意义务,从业人员违反标准义务的行为存在构成犯罪的风险。同时,说明了在包装技术领域的犯罪中,包装技术标准对刑法的应用具有重要辅助功能。Taking the grave case of“7·22”bus burning accident in Xinyang,Henan province as an example,the analysis was made on the special duty of care of the employees endued by the dangerous cargo transport and packaging standard,and the risk of constituting a crime in the employees’behavior for violating the packaging standard obligations.At the same time,it showed that in the field of packaging technology crime,the packaging technology standard had an important auxiliary function in the application of criminal law.
