摘 要:我国新颁布的《民法典》创造性地将人格权独立成编,并对人格权的适用规则和各项具体人格权进行了系统性的规定,从此人格权法自成体系,并与其他单行法律并列。在我国《民法典》制定背景下,人格权经济效益越来越明显,自然人的人格权商业价值也越来越突出,大量的人格标识被赋予商业化价值,公民的人格权未经授权被非法利用,从而给公民的人格利益带来了极大的市场风险,使公民的人格权无法得到切实的保护。因此,必须采取一系列措施对商品化的人格权进行切实有效的法律保护。In the newly promulgated Civil Code,the right of personality is creatively compiled independently,and the applicable rules of personality right and specific personality rights are systematically stipulated.Since then,the law of personality right in China has been self-contained and parallel with other single laws.In the context of the establishment of Civil Code,the economic benefits of personality right are becoming more and more obvious,the commercial value of personality right of natural persons more and more prominent.A large number of personality marks are given commercial value,and the personality rights of citizens are illegally used without authorization,which brings great market risks to the citizens’personality interests,making the citizens’personality rights unable to be effectively protected.Therefore,a series of measures must be taken to protect the commercialized personality right effectively.
