澳大利亚医学专家证人对我国专家辅助人制度的启示

摘　　要：通过对澳大利亚医学专家作为专家证人的介绍,对比我国专家辅助人制度中的医学专家的角色定位以及作证程序等相关问题,借鉴澳大利亚医学专家作为证人的经验并结合我国医疗损害诉讼实际,提出细化规范我国医学专家辅助人的资格认定、加强对意见的综合考量以及医学专家辅助人的专业培训、确立医学专家辅助人的法律责任和监督惩罚机制等法律建议,完善我国专家辅助人制度在医疗损害诉讼中的应用。Through the introduction of the system of Australia physicians as expert witnesses,the role positioning is compared and procedure issues of expert auxiliary system is testified in China.Through learning from the Australian medical expert witness system and combine the medical damage lawsuit in China,it is suggested to standardize the accreditation of medical expert assistant,strengthen the comprehensive consideration and professional training of medical expert assistant,establish medical expert assistant legal responsibility,supervision and punishment mechanism,and improve the application of China’s expert auxiliary system in medical injury lawsuits.
