摘　　要：串通投标行为在招投标领域内较为常见,但因其隐蔽性强,且司法取证难,该行为在司法实践中难以入罪。串通投标行为限制市场竞争、扰乱市场秩序,社会危害较大。该行为以围标、陪标行为居多,而围标、陪标行为违法成本低,具有常发性,成为招投标法律领域严厉打击的对象。Collusive bidding is relatively common in the field of bidding and tendering.But because of the concealment of the behavior and the difficulty of obtaining evidence in the judicial field,it is difficult to define it as a crime in judicial practice.The collusive bidding behavior restricts the market competition and disrupts the market order,causing great harm to the society.The behaviors are mostly conspired bidding and accompanying bidding.The conspired bidding and accompanying bidding behaviors have low illegal costs and are recurring.They have become the objects of severe crackdown in the bidding law field.
