论国家文化法制体系——基于文化与法治关系的理论视角

摘　　要：“国家文化法制体系”不仅是“国家”的“文化法制体系”,也是“(民族)国家文化”的“法制体系”。从我国文化宪法的基本构架来看,我国社会主义文化法制的基本内容,主要是以宪法上的“建设社会主义文化强国”等“国家目标规定”为依据,以“文化基本制度”为基础,以“文化基本权益保障”和“国家文化职权”为“主线”,包括“文化权益保护法制”、“公共文化服务法制”、“文化市场管理法制”与“文化产业促进法制”等国家“文化法制”类型。从行政宪制主义的理论视角,还可以根据文化行政部门的职责分工,归纳出另外七种文化法制类型:文化艺术法制、文化教育法制、文化遗产法制、新闻出版法制、广播电视法制、广告与电影法制、对外文化交流法制等。The"national cultural legal system"is not only the"cultural legal system"of the"state",but also the"legal system"of the"national culture".It is understood,from the point of the basic framework of the cultural constitution in our country,the basic content of legal system of socialist culture in our country could be including:"the construction of socialist culture power"such as"targeted state regulations"as the basis,based on the basic system of"culture",to"cultural basic rights and interests"and"national cultural authority",including"cultural rights and interests protection law","public culture service legal system","cultural market management law"and"culture industry promotion nomocracy".From administrative perspective of constitutional theory,we can also summarize seven other types of cultural legal system,this is known as:"culture art nomocracy","cultural education legal system","cultural heritage legal system","press law","radio and television law","advertising and film legal system","foreign culture exchange legal system".
