社区语境下的矫正制度与矫正维度中的社区建构——基于犯罪社会学理论视野的概念化分析

摘　　要：社区矫正是一种以社区环境为基础的创新刑法执行方式。过于关注政策建构而忽略矫正的外部社区环境,使得我国社区矫正在本土化实践中遭遇难题。立足于我国社会发展之现实,从犯罪社会学视角分析可以发现,并非所有的社区都天然适合社区矫正。进行社区矫正的社区除具备地域及人口特质外,还应具备“密切而理性的社会交往”“积极的共同价值、利益”以及“社区居民宽恕、包容的态度”三个特质。需要从立法和执法上科学设计社区发展路径,建构社区矫正基础评估制度,加强以社区矫正价值为内容的宣传引导,并以恢复性司法措施为抓手重构社区成员的整合性耻辱意识,以求真正发挥社区矫正重建社区矫正对象社会化能力的功效,实现成功的犯罪矫治。Community correction is an innovative method of punishment that is rooted in the community setting.However,the localized practice of China's community correction is facing difficulty due to the lack of attention paid to the community settings while focusing solely on legislation.Based on the reality of China's social development,a criminological analysis reveals that not all communities are suitable to carry out community correction programs.Other than its location and demography,a community also needs three other characteristics to carry out meaningful community correction,namely“the close and rational social interaction”,“the positive shared value system”,and“the forgiving and tolerant attitude toward ex-offenders”.In order to achieve those,we need to design the path of community development scientifically,establish a community assessment system for correction suitability,and strengthen the promotion of a value system that encourages rehabilitation,and focus on restorative justice and the shaping a mentality of reintegrative shaming among community members.
