摘 要:尽管近年来不断有学者对买卖不破租赁规则进行质疑,甚至有学者提出以登记对抗主义替代买卖不破租赁规则,但在新颁布的《中华人民共和国民法典》(以下简称《民法典》)中仍然肯定了买卖不破租赁规则继续存在之必要,并且在原《中华人民共和国合同法》(以下简称《合同法》)立法的基础上迈出了占有对抗主义的步伐,只是占有对抗主义还是无法彻底解决买卖不破租赁规则在适用上存在的难题。因此建议在未来的立法或司法解释中对买卖不破租赁规则的适用条件予以细化:将租赁合同的类型区分为长期、短期、商业和普通租赁,并引入附条件登记对抗主义。Although in recent years,some scholars have continuously questioned the existence of the rules of non-breaking leases for sale and purchase,and some scholars have even proposed to replace the rules of non-breaking leases for sale with registration confrontation,but the newly promulgated“Civil Code”still affirms the continued existence of the rules for sale without breaking lease Necessary,and on the basis of the original“Contract Law”legislation has taken the steps of possessive antagonism,but possessive antagonism can not completely solve the problem of the application of the rules of sale without breaking the lease.Therefore,it is suggested that in future legislation or judicial interpretations,the applicable conditions of the lease rule should be refined:the types of lease contracts are divided into long-term,short-term,commercial and ordinary leases,and conditional registration confrontationalism should be introduced.
