自由贸易港与单独关税区的关系辨析与启示

摘　　要：自由贸易港和单独关税区在产生时间和意图、地位和范围、经济自主权、开放水平等方面都存在不同。自由贸易港本质在"自由",单独关税区实质在"单独",两者没有直接的因果关系,也没有从属、先后或递进的关系,两者属于并行不悖的两套制度,可分别单独存在也可同时存在,同时存在时两者相互补充相互促进。设立海南单独关税区并不是海南自由贸易港成功建设必不可少的条件,但若同时为海南单独关税区,可提高海南自由贸易港制度的针对性和稳定性,提高效率,获得更有利的国际经济条件,加快促进海南自由贸易港建设。设立海南单独关税区具有可行性,但当前障碍重重,应先行进行海南自由贸易港建设。The free trade port is different from the separate customs territory in the dates and intentions of their formation,their statuses and scopes,their economic autonomy,and their opening levels,and so on.While the essence of free trade port is freedom,the essence of separate customs territory is independence.There exists neither a direct causal relationship nor a subordinate,sequential or progressive relationship between the two.They actually belong to two systems that go hand in hand,which can exist separately or simultaneously,and complement and promote each other when existing together.Although the establishment of Hainan separate customs territory is not an essential condition for the successful construction of Hainan Free Trade Port,its existence can surely improve the pertinence and stability of Hainan Free Trade Port system,improve the efficiency,obtain some more favorable international economic conditions,and promote the construction of Hainan Free Trade Port.While it is feasible to set up a separate customs territory in Hainan,many obstacles still exist at present,and hence a free trade port should be built first.
