软件反向工程规避技术措施例外研究

摘　　要：2020年4月30日,全国人大常委会公布了《中华人民共和国著作权法(修正案草案)》,草案“第四十八条”将软件反向工程纳入(列为第5款),规定“进行加密研究或者计算机软件反向工程研究”,可以避开技术措施。该条款不仅在著作权法层面上确认了软件反向工程的合法性,而且弱化了技术措施对软件反向工程的限制,有利于算法黑箱透明化,促进计算机软件产业的发展。但是该条款未对实施软件反向工程的条件和规则进行具体规定,因此还有待进一步研究和完善。On April 30,2020,the Standing Committee of the National People′s Congress promulgated The Copyright Law of The People′s Republic of China(Draft Amendment).Article 48(5)of the said draft amendment includes the software reverse engineering for the first time,which stipulates that encryption research or computer software reverse engineering research are allowed to avoid technical measures.This article not only confirms the legality of software reverse engineering at the level of copyright law for the first time,but also weakens the restrictions of technical measures on software reverse engineering,which is conducive to the transparency of algorithm black box and promotes the development of computer software industry.However,the article does not specify the conditions and purposes of software reverse engineering.So,it needs further research and improvement.
