摘 要:在学位立法尚不健全的前提下,高校学位评定委员会对学术问题施以实质审查的实践做法,源于政策工具的职责拓展,亦为不少高校的学位管理细则所强化。但这种制度设计不符合有限立法规则的体系解释和学位授予活动的客观规律,折射出行政权力对学术权力的僭越以及学术治理的科层化趋向。学位授予的核心在于学术自治,学位评定委员会内嵌于三级学位管理体制之中,应然职责在于行政批准而非学术判断。从权力配置的功能适当性考虑,其应承担学位授予质量的程序把关权,并因应职权需要完善机构名称、组织结构、运行制度和决策机制等,体现"学术与行政相对分离"的逻辑。On the premise of imperfect legislation,the practice of substantive review by the academic degree assessment committee stems from the policy provisions and is also strengthened by many university management rules.However,this kind of system design is not commensurate with the systematic interpretation of the limited legislative rules and objective law of academic degree awarding activities,reflecting the confusion of administrative power and academic power.The academic degree assessment committee is embedded in the three-level academic degree management system and shoulders the responsibility of administrative approval rather than academic judgment.Considering the functional appropriateness of power allocation,which is responsible for the formal review of academic degree awarding quality.In response to the need of authority,the institution name,the organizational structure,the way of deliberation and the decision-making mechanism should be improved.
