关于将食品监管渎职罪修改为食品安全渎职罪的思考

摘　　要：向社会公开征求意见的《刑法修正案(十一)(草案)》中关于"食品监管渎职罪"的修改引发了社会热议。以我国关于食品安全工作要求为指导,本文建议把食品监管渎职罪修改为食品安全渎职罪,将犯罪主体确定为负有食品安全监督管理职责的国家机关工作人员。在犯罪构成要件中,建议增加导致发生重大事故或者造成其他严重后果的条件,并明确食品安全渎职犯罪的具体情形。The Criminal Law Amendment(11)(Draft),which is open to public for comments,has caused heated discussions in the community on the amendment to the crime of malfeasance in food supervision.Base on the latest requirements on food safety,the article proposes to amend the crime of malfeasance in food supervision to the crime of malfeasance in food safety,and determine the subject of the crime as the staff of the state agency responsible for food safety supervision and management.Among the elements of the crime,it is recommended to add conditions that lead to major accidents or cause other serious consequences,and clarify the specific circumstances of food safety malfeasance in accordance with national regulations.
