摘　　要：民办图书馆现行立法存在立法分散、培育扶持不足、协调性可操作性不够、制度设计不科学的问题。本文提出的以下几方面策略可完善民办图书馆立法:修改《公共图书馆法》,完善民办图书馆专门立法;加强对民办图书馆的培育扶持和权利保障;增强立法的体系协调性及具体明确可操作性;立足实际,进行科学合理的制度设计,包括备案设立与审批设立分类规制、建立文化主管部门为主的管理模式。The current legislation of private libraries has some problems such as legislation decentralization insufficient support and cultivation lack of coordination and operability and unscientific system design.The private library legislation could be improved by revising the Public Library Law,promoting specific reluations and rules ofthe private library,focusing on the cultivation and support of private libraries and protecting their rights,and enhancing the system coordination of legislation and operability.A scientific and reasonable system should be designed based on the reality,including setting up classified regulations in registration and approval,and being managed by the cultural department.
