摘　　要：全球金融治理的规则体系已经初步形成,但无论是条约、习惯法或一般法律原则等硬法规则,还是宣言、监管标准等软法规范,都在不断扩张,相继引起国际金融法体系规模上的持续扩大。但是,治理规则数量上的增加和所涉领域的扩张,并不意味着国际金融治理趋向于更加有效和公正,也不能说明国际金融法体系已经形成自动闭合循环的执行结构。相反,在国际金融实践中,规则制定主体较乱,规则之间缺乏内在联系和协调,条块结合性不强,使得国际金融法律体系呈现出严重的“碎片化”倾向,导致国际金融规则在实施中外溢出价值变更和较多执行冲突。因此,国际公法语境下的“履行”或“遵守”等执行话语,已经不能真实反映国际金融治理的现状和兼有私法内容的契约执行规律。未来全球金融规则的实施,需要构建全球金融规则的法律位阶和实施评估机制,形成与公法的“遵守”相区别的带有主动履行的实施理念。The rules system of global financial governance has been initially formed,whether it is hard law rule such as treaty,customary law or general principles of law or soft law such as a declaration or a regulatory standard,they are constantly expanding,which has caused continuous changes in international financial law.However,the increase in the number of governance rules and the expansion of the relevant law areas,do not mean that international financial governance is more effective and fair,nor do they mean that the international financial law system has formed an executive structure of an automatic closed loop.On the contrary,in the practice of international finance,the chaotic subjects of rulemaking,the lack of internal connection and coordination between rules,and the lack of strong integration of articles,have made the international financial law system show a serious“fragmentation”tendency,which leads to many execution conflicts.Therefore,those words based on“Enforcement”or“Compliance”under the context of international public law can no longer truly reflect the current status of international financial governance and the law of contract enforcement with private law contents.In the future,the implementation of global financial rules calls for the establishment of the legal hierarchy of global financial rules and the implementation evaluation mechanism.The international community should strive to form an implementation philosophy with active implementation that is different from the“compliance”of international public law.
