摘　　要：咨询委员会是香港廉政公署监察与制衡体系中的重要组成部分,因在维护公众对廉政公署的信心方面发挥的重要作用而在廉政公署监督体系中具有独特的地位。由社会人士组成的咨询委员会承担监督廉政公署的职能既有历史的原因,也是现实的需要。廉署咨询委员会以维护公众信心为核心调整监督重点,在充分发挥咨询参谋、桥梁纽带、舆论引导作用的基础之上,令非强制性的监督得以落到实处。借鉴香港廉政公署咨询委员会之经验,国家监察委特约监察员工作中应注重维护公众信心,协同发挥特约监察员监督、咨询、联结、引导的多元功能,以技术性的咨询、联结、引导功能促进监督功能的实现。可将特约监察员划分成若干功能小组,根据各功能小组的需要选拔具备公信力、专业性及代表性的公信人士担任小组委员,有利于强化特约监察员对监察机关的监督,防止“灯下黑”。As an important part of the ICAC’s system of monitor and balance,the Advisory Committee holds a unique position in the ICAC’s monitoring system because of its important role in maintaining public confidence in the ICAC.There are both historical reasons and practical needs for the advisory Committee composed of non-official members to oversee the ICAC.The ICAC Advisory Committee has adjusted its monitor focus to maintain public confidence.They have given full play to their advisory role,bridging the gap and guiding public opinion,so that non-mandatory oversight can be implemented.Learning from the Institutional arrangement and the practice of the Advisory Committee of Hong Kong ICAC,it is suggested for the guest ombudsmen of the National Supervisory Commission in the mainland that the system should address to maintain public confidence,to give full play to their functions of supervision,consultation,engagement and guidance,and to facilitate the realization of their supervisory function with technical consultation,engagement and guidance.They could be divided into several functional groups according to the needs of supervision.The credibility,expertise and representativeness of the members is conducive to the enhancement of the supervision and prevention of“darkness under the light”.
