摘　　要：众所周知新型冠状病毒性肺炎(以下简称新冠肺炎)已演变为全球性公共卫生事件,全人类面临共同的挑战,世界处在体现“人类命运共同体”这一理念的关键时刻。中国应对新冠肺炎取得阶段性胜利,应对措施也成为中国方案和经验,例如党的统一领导、政府的有力主导、医务人员的顽强拼搏、武汉人民乃至全国人民全力配合等。但同时这次抗击疫情是对国家治理体系和治理能力的一次大考,也暴露出许多短板与不足,例如应急储备不足、重大疫情防控体制机制不顺、公共卫生应急法律体系不完备不完善等。这些现象背后的原因有的是制度层面的问题,有的是执行层面的问题,还有的是监督层面的问题。以法治思维去考量,全面提高依法防控和依法治理能力应从立法、执法、司法、守法各环节发力,但首先应从完善相关法律体系着手,良法是善治的前提。习近平总书记强调,疫情防控越是到最吃劲的时候,越要坚持依法防控。It is well known that the new coronavirus pneumonia disease(hereinafter referred to as COVID-19)has evolved into a global public health pandemic.All mankind is facing a common challenge,and the world is at a critical moment to embody the concept of“community with a shared future for mankind”.China has won a phased victory won the battle against in dealing with COVID-19 at present,and the response measures have also become China's strategy and experiences・Such as the unified leadership of the Party,the strong leadership of the government,the tenacious struggle of medical personnel,the full cooperation of the people of Wuhan and even the people of the whole country,and so on.But at the same time,the fight against the pandepidemic is a big test of the national governance system and governance capacity,exposing many shortcomings and deficiencies.For example,the emergency reserve is insufficient,the system and mechanism of major epipandemic prevention and control is not smooth,and the legal system of public health emergency is not perfect.Some of the reasons behind these phenomena are problems at the institutional level,some at the implementation level,and some at the supervision level・Considering from the perspective of the thinking of the rule of law,the comprehensive improvement of the ability of prevention and control and governance according to law should be carried out from the aspects of legislation,law enforcement,judicature and abiding by the law.But first of all,we should start with improving the relevant legal system,and good law is the premise of good governance.President Xi Jinping stressed that the more energetic the panepidemic prevention and control is,the more necessary it is to persist in prevention and control in accordance with the law is.
