论我国民商事判决在荷兰的承认与执行——兼评荷兰首例承认与执行中国判决案件

摘　　要：在推行全球治理思想和法治中国建设的背景下,促进民商事判决的跨国间流通有利于保护当事人合法权益,深化国际司法领域协调合作并推进国际民商事秩序合理发展。通过梳理荷兰承认与执行外国判决的三种具体路径并结合相应司法实践,有助于厘清我国民商事判决在荷兰得到承认与执行应满足的程序要求和审查标准,提升判决的可执行性并促进判决在荷兰、欧洲乃至世界的流通。我国应更加积极地参与相关国际条约的规则制定并推动其批准生效,进一步完善判决作出中程序性事项的规范性和公正性,并借鉴其他国家承认与执行外国判决的考量标准和实施路径,推动民商事争端在国际协作与国内规范的交织互动下得到有效解决。In the context of global governance and the rule of law in China,promoting the cross-border circulation of civil and commercial judgments is beneficial to protect the legitimate rights and interests of the parties,deepen the coordination and cooperation in the international justice field and strengthen the development of reasonable international civil and commercial order.By demonstrating three specific ways of recognition and enforcement of foreign judgments in the Netherlands and combining with the corresponding judicial practice,it is helpful for China to clarify the procedural requirements and review standards,enhance the enforceability of Chinese judgments,smooth the circulation of judgments in the Netherlands,Europe and even the world.China should also actively participate in the rule making of relevant international treaties and give impetus to the ratification,further improve the standardization and impartiality of procedural matters in the judgment making,and appropriately learn other countries’judicial standards of recognition and enforcement of foreign judgments to advance the substantive and effective settlement of civil and commercial disputes under the interaction between international cooperation and domestic norms.
