摘  要:法治建设应当以什么为最终抓手,以什么为评价标准,以什么为实现形态?这既是法学理论研究的方向性问题,也是法治建设实践的目标性问题。本文的基本观点是:在立法机关已经出台277部法律、中国特色社会主义法律体系已经形成、法律实施成为主要矛盾、社会主体的法治意识不是很高的情况下,法治建设的目标要以生成合乎法治的案例为归宿。从立法开始打造执法、司法、信法、守法直至案例的法治链条体系,将法治建设的重心由制定规范转移到生成案例,把案例作为认识法治、评价法治、推进法治和实现法治的抓手和资源。充分运用案例法治智慧和案例法学理论,丰富、完善中国特色社会主义法治的规范体系、制度体系、理论体系和话语体系等。What should be the key to the construction of the rule of law?What criteria should be adopted for evaluating the results?And in what form should it be realized?These questions concern not only the orientation of legal theory but the direction of the practice of rule-of-law as well.In China,the legislature has issued 277 laws,the socialist legal system with Chinese characteristics has been formed,the implementation of the law has become the main contradiction,but the citizens'awareness of rule of law is not very strong.Facing such a reality,we argue that the target of the rule-of-law construction should be the establishment of enough cases in agreement with the spirit of rule of law.In order to achieve this goal,we should create a rule-of-law chain system starting from legislation to law enforcement to justice to law implementation to law observance and to the establishment of guiding cases.The focus of the rule-of-law construction should be shifted from formulating norms to generating guiding cases,which can be used as key resources for understanding rule of law,evaluating the construction of rule of law,and advancing rule of law.In addition,we should make full use of the wisdom of case-based theory and practice of rule of law to enrich and improve the normative system,institutional system,theoretical system and discourse system of the socialist rule of law with Chinese characteristics.
