中国高校性骚扰防治制度的体系研究——以《民法典》第1010条为中心

摘　　要：《民法典》规定学校对性骚扰负有预防、受理投诉、调查处置等义务,将高校防治性骚扰的义务提升到民事基本法层面。本文针对这一规定,结合我国高校性骚扰防治存在的制度漏洞,提出防治高校性骚扰的体系构想:在完善高校内部性骚扰的防治规则、受理投诉和调查处理等相关制度的同时,完善相关法律、政府行政管理和司法救济等相关制度,为将来的中国高校性骚扰防治提供体系化的制度设计,遏制高校性骚扰的蔓延态势。The Civil Code stipulates that schools shall prevent,accept complaints of,investigate and handle sexual harassment,raising the obligation to the level of basic law.This paper proposes a new system concept in light of this provision and the loopholes in China’s university sexual harassment prevention and control system:improving the rules for sexual harassment prevention and control,complaints acceptance,investigation and handling in colleges and universities,while ameliorating the legal system,government administration and judicial remedy system outside schools,so as to provide a prevention and control system to curb the spread of sexual harassment in colleges and universities.
