摘　　要：构建完善的法人治理结构是我国营利性民办高校实现法人治理的根本保证和基本条件之一,也是我国民办高校分类管理不可或缺的内容。但由于我国尚未单独规定此类高校的法人治理结构,致使其发展受限,这对于我国民办教育行业来说是十分不利的。事实上,营利性民办高校同时具有营利性和公益性双重属性,推动其法人治理结构构建不仅有利于两种属性实现,对我国社会主义教育事业的发展也具有重要意义。因此,在法律上对其法人治理结构进行单独规定,明晰各机构职权,加强政策支持,制定合理有用的监督管理体系,都是构建其法人治理结构不可缺少的举措。Constructing a perfect corporate governance structure is one of the fundamental guarantees and basic conditions for the realization of corporate governance in China's for-profit private colleges and universities.It is also an indispensable part of the classified management of China's private colleges and universities.However,because our country has not separately stipulated the corporate governance structure of such colleges and universities,its development is limited,which is very unfavorable to the private education industry in our country.In fact,for-profit private colleges and universities have both for-profit and public welfare properties,and promoting the construction of their corporate governance structure is not only conducive to the realization of the two properties,but also of great significance to the development of China's socialist education.Therefore,it is necessary to stipulate the corporate governance structure separately in law,clarify the functions and powers of each institution,strengthen policy support,and formulate a reasonable and useful supervision and management system.
