外国人才签证制度“一体双元”问题对策研究--以中韩比较法为视角

摘　　要：外国人才签证制度在吸引和留住外国人才方面,发挥着重要作用。然而,实践中出现了“引人”和“留人”的“一体双元”问题,对之研究具有重要的现实价值。通过分析“吸引什么样的外国人才”“如何留住外国人才”“用好外国人才”之间的递进关系,以及韩国政府为解决“一体双元”问题提出的韩国方案,指出细化以国内需求为核心的外国人才准入机制和以外国人才需求为核心的国内融合机制是解决外国人才签证制度“一体双元”问题的有效途径。In the face of fierce global competition for talents,foreign talent visa system plays an important role in attracting and retaining foreign talents.However,the problems of“attracting”and“retaining”occur in the application,which have important practical value for the research.This paper analyzes the relationship among“what kind of foreign talents to attract”,“how to retain foreign talents”and“how to make good use of foreign talents”.Based on the analysis of the Korean government’s solution to the“dual problem”of Korean visa system,this paper holds that establishing a detailed entry mechanism of foreign talents for domestic demand as the core and domestic integration mechanism with foreign talents demand as the core is an effective way to solve the dual problem of foreign talents visa system.
