摘　　要：现阶段,非正常申请正在冲击我国专利审查体系,引发社会各界广泛关注。本文针对近期发明专利非正常申请出现的新特点和新变化,分类介绍了其在审查实践中的主要表现形式,以此为基础总结出非正常申请的本质特征——非市场性,并探讨了非正常申请在专利基础理论、行政规制手段等方面的问题。At present,abnormal patent applications are impacting China's patent examination system,attracting extensive attention of the society.Contraposing the new features and changes in recent years,this article introduces the main manifestations of abnormal invention patent applications in the practice of examination,and on this basis,summarizes the essential feature of abnormal patent applications:nonmarketability.The article also discusses the issues of patent basic theory and administrative regulations.
