摘 要:2019年8月开放签署的《新加坡公约》通过明确肯定国际商事调解协议的执行力,正式强调了国际商事调解独立解决国际争议的价值。在我国,商事调解的发展起步较晚,长期以来调解协议仅具有“民事合同性质”地位,国内现行的执行途径与公约构建的国际商事调解协议跨国执行机制存在较大冲突。考虑到《新加坡公约》所体现的全球调解发展趋势,我国应当尽快建立起一套符合我国国情的国内商事调解法律制度,包括加强调解员队伍的建设与制定独立的商事调解法,以良好衔接《新加坡公约》规则。The Singapore Convention,which was opened for signature in August 2019,clearly affirms that international commercial mediated settlement agreements are enforceable,and since then it has emphasized the value of international commercial mediation in independently resolving international disputes.In China,the development of commercial mediation started late.For a long time,mediated settlement agreements only possess the status of“civil contract nature”.The domestic enforcement methods conflict with the cross-border enforcement mechanism of international commercial mediated settlement agreements established by the Convention.Considering the development trend of global mediation reflected in the Singapore Convention,China should establish a set of domestic commercial mediation legal system in line with national conditions as soon as possible,including strengthening the construction of the mediators and formulating an commercial mediation law to ensure a good connection with the Convention.
