摘　　要：我国工伤认定领域存在行政认定程序和行政诉讼程序循环往复的现象,不仅浪费行政资源和司法资源,还无法及时保障劳动者权益,易激化社会矛盾。造成这一问题的原因,表面上看是行政认定与司法审查的标准不统一,实质上源于工伤认定行政权与司法权的冲突。破解这一困境可以采取渐进性的策略:在维持行政机关行使工伤认定权的现状下,确立法院对工伤认定的司法变更权,对行政机关重新作出具体行政行为的内容进行适当的限定,保障工伤认定行政程序与司法审查程序相一致、相连贯;从长远来看,要确立适度改良的工伤认定一元模式,即赋予司法机关对工伤认定的最终决定权,提高工伤认定的效率和权威。In the field of on-the-job injury identification in China,there is a phenomenon that administrative identification procedure and administrative litigation procedure go back and forth,which not only wastes administrative and judicial resources,but also fails to protect the rights and interests of workers in time,which easily aggravates social conflicts.On the surface,the reason for this problem is that the standards of administrative identification and judicial review are not unified,and in essence,it stems from the conflict between administrative power and judicial power of on-the-job injury identification.To solve this dilemma,we can adopt a gradual strategy:under the current situation of maintaining the administrative organ′s exercise of the power of on-the-job injury identification,we should establish the court′s judicial right to change the determination of on-the-job injury,and appropriately limit the content of specific administrative acts made by administrative organs,to ensure the consistency and coherence of the determination procedure of occupational injury and the judicial review procedure.In the long run,it is necessary to establish a moderately improved unitary mode of on-the-job injury identification,that is,to endow the judicial organ with the final decision power on the determination of on-the-job injury,so as to improve the efficiency and authority of on-the-job injury identification.
