摘　　要：海南自由贸易港旅游业开放离不开稳定的法治保障,在法治保障方面主要存在事权配置错位、法律法规体系不够健全、制度建设尚未完善等现实困境。旅游业开放的法治保障路径主要有构建清晰的事权分配格局、完善自贸港内的法治保障体系、加强旅游业开放的制度创新这三大层面。The opening of tourism in Hainan Free Trade Port is inseparable from the stable legal guarantee.In terms of the legal guarantee,there are realistic dilemmas such as misplaced allocation of powers,insufficient law and regulation system,and imperfect institution construction.The path of legal guarantee for tourism opening has mainly three aspects:building a clear distribution pattern of powers,perfecting the system of legal guarantee in the free trade port,and strengthening the institutional innovation of tourism opening.
