摘　　要：DNA鉴定技术在刑事司法中的广泛应用,为大量案件侦破提供了关键证据。但DNA鉴定目前还存在一些有待解决的问题,如管理体制不够科学、鉴定规则和评价标准不统一、监管效力不足等。对此,应首先明确DNA鉴定工作的基本原则,即法定原则、科学原则和统一原则;其次,建立健全司法鉴定机构的准入制和鉴定人的资质审查管理;最后,严格规范涉及DNA证据的诉讼程序的审查质证,并建立和完善DNA鉴定技术的动态监督评估机制。DNA technology has been widely used in criminal justice and provided crucial evidence for massive cases.However,there are still some unsolved problems in DNA identification at present,such as the unreasonable administration system,the disunity of identification and evaluation,the lack of regulation.Therefore,the basic principles including legal principle,science principle and unity principle for DNA identification should be defined.Secondly,the admission system for forensic institution and qualification management for practitioners should be established and improved.Thirdly,the proof examination related to DNA technology in legal proceedings should be strictly regulated,and the dynamic evaluation mechanism of DNA technology should be established and improved.
