摘  要:高校和学生之间的负面新闻越来越多地呈现在公众面前,已严重阻碍了高校学生管理法治化、规范化的发展路径。在法治国家建设和高校法治化进程快步推进的当下,公开公正原则、正当程序原则等行政法基本原则正悄然被高校学生管理体系所适用。在《普通高等学校学生管理规定》颁布并实施的背景下,应在对高校行政公权力与自主管理权进行正确界定的基础上,重新确立高校行政法律地位,从行政法基本原则、法律体系以及正当程序等角度对高校学生管理的相关问题加以解读,寻求高校学生管理中学术自治与学生权益保护平衡化的基点。More and more negative news between colleges and students are presented to the public,which has seriously hindered the development path of legalization and standardization of college student management.With the rapid development of the construction of a state ruled by law and the process of legalization in colleges and universities,the basic principles of administrative law,such as the principle of openness and justice,the principle of due process,are quietly applied to the management system of college students.Under the background of the promulgation and implementation of the regulations on the management of college students,we should re-establish the administrative legal status of colleges and universities on the basis of the correct definition of the administrative public power and the independent management power of colleges and universities,and interpret the relevant problems of college students management from the perspective of the basic principles of administrative law,legal system and due process,so as to seek self-learning in the management of college students and the basic point of the balance between governance and the protection of students'rights and interests.
