摘　　要：海洋命运共同体的法理基础是共同体原理。它不仅是对《联合国海洋法公约》体系两大原理(传统自由原理和主权原理)的补充,并已在以人类共同继承财产原则为基础的国际海底区域制度内得到固化和发展。和谐海洋理念和人类命运共同体理念所蕴含的原则和精神,与海洋命运共同体倡导的价值取向和目标愿景一致。因为它们不仅符合经济和社会发展的要求,而且符合维系海洋秩序规则的本质和特征,所以,应完整地用于海洋命运共同体的构建过程中。要实现这些价值和目标,如构建人类命运共同体进程一样,需要分步骤、分阶段、有重点地推进,才能实现海洋命运共同体目标愿景,特别需要合理处理影响海洋命运共同体进程的重大问题,为此,既要遵守已经达成的共识和协议,并应创造条件为最终解决海洋权益争议做出努力,也要运用已有的多种平台和新设的平台,共同为构建海洋命运共同体和完善海洋命运共同体理论体系做出贡献。The legal basis of building the maritime community with a shared future is the principle of community,which is not only a supplement to two principles in the system of the United Nations Convention on the Law of the Sea(the traditional principle of liberty and the principle of sovereignty),but also has been consolidated and developed in the international seabed regime that is based on the principle of the common heritage of mankind,so the principles and spirits enshrined in the concepts of harmonious ocean and the community with a shared future for mankind are totally consistent with the values,orientations,goals and visions advocated by the maritime community with a shared future.Because they do not comply with the requirements of economic and social development,but also correspond to the essence and features of rules on maintaining the ocean order,so they shall be fully applied to the course of building the maritime community with a shared future.In order to realize such values and goals,the course needs to be advanced in a step-by-step,phase-by-phase and focused manner just as that of building the community with a shared future for mankind,especially major issues influencing the progress of the maritime community with a shared future shall be dealt with rationally,thus the goals and visions of the maritime community with a shared future will come true.In this regard,the international community shall not only comply with the existing consensus and agreements and create conditions with efforts for the final settlement of marine disputes,but also utilize the existing multiple platforms and newly-established platforms to jointly make contributions to building the maritime community with a shared future and improving the theoretical regime on the maritime community with a shared future.
