我国自然保护地土地权属管理中存在的问题及对策

摘　　要：土地权属问题是推进我国自然保护地建设所面临的根本性问题。目前,自然保护地土地权属管理中存在的问题严重阻碍着自然保护地土地生态公益性的发挥。通过梳理和分析我国自然保护地土地权属立法和管理实践可以发现我国自然保护地土地权属在立法、集体土地权益保护和管理实践方面存在着突出问题。立法机关应当通过立法明确相关主体在自然保护地土地之上的权利义务关系,构建科学合理的自然保护地土地权利体系;行政机关应当通过完善集体土地征收制度、采取多样化的集体土地流转方式以及确立保护地役权制度的多元路径来协调社区居民权益与自然保护地建设之间的关系;各级政府应当赋予自然保护地管理机构权力,构建统一事权、直接管理与间接管理相结合的高效管理体制,实现由自然保护地管理机构直接统一行使土地管理权的目的。The problem of land ownership is the fundamental problem to promote the construction of natural protection areas in China.At present,the problems existing in the land ownership management of natural protection land seriously hinder the development of ecological commonweal of natural protection land.Through sorting out and analyzing the legislation and management practice of the land ownership of natural protection land in China,it can be found that there are outstanding problems in the legislation,collective land rights protection and management practice of the land ownership of natural protection land in China.The legislature should clarify the rights and obligations of the relevant subjects on the land under natural protection through legislation,and construct a scientific and reasonable land rights system under natural protection.The administrative organs should coordinate the relationship between the rights and interests of community residents and the construction of nature reserve by perfecting the system of collective land expropriation,adopting diversified ways of collective land circulation and establishing multiple paths of the system of easement protection.Governments at all levels shall empower the administrative agencies for natural protected areas with the power to establish an efficient management system combining unified administrative authority,direct management and indirect management,so as to realize the purpose of directly and uniformly exercising the right of land management by the administrative agencies for natural protected areas.
