区域发展权视角下的地方协同立法

摘　　要：地方协同立法是不同区域的立法主体针对共通性或牵连性事项制定共同规则的过程和结果。区域一体化发展的法律保障是地方协同立法,一体化发展的目的即是解决区域发展利益不平衡问题。区域发展权从人权的高度关怀区域发展利益不平衡问题,是地方协同立法的权利基础和指导理念。立法是一项利益协调活动,为保障协同立法相关区域主体的发展利益,地方协同立法应确定区域平等、利益均衡和开放参与三项原则。根据上述原则,应构建和完善不同区域、不同部门之间在横纵向、内外部上的沟通协作机制,建立并优化获益主体与受损主体在重要事项和领域上的补偿性利益流动机制,健全社会公众有效影响协同立法的全过程参与机制以及立法主体间的交叉备案审查机制。Local coordinated legislation is the process and result of the legislative bodies in different regions formulating common rules for common or implicated matters.The legal guarantee for regional integrated development is local coordinated legislation,and the purpose of integrated development is to solve the problem of unbalanced interests in regional development.The right to regional development cares about the imbalance of regional development interests from a high degree of human rights.It is the right foundation and guiding concept of local coordinated legislation.Legislation is an interest coordination activity.In order to protect the development interests of regional subjects related to coordinated legislation,local coordinated legislation should determine the three principles of regional equality,interest balance and open participation.According to the above principles,it is necessary to construct and improve the horizontal,vertical,internal and external communication and cooperation mechanisms between different regions and different departments,and establish and optimize the compensatory benefit flowmechanism between the beneficiaries and the losers in important matters and fields.Improve the public participation mechanism in the whole process of effectively influencing collaborative legislation and the cross-filing review mechanism between legislative subjects.
