论我国公民体育权利的法律保障

摘　　要：随着时代进步,法律体系的不断地完善,我国逐渐在法学重点研究课题中引入了公民体育权利这个研究课题。在国际上,公民体育权利也只是近几十年才开始提出的。所以关于公民体育权利的保障以及执行力度的研究还不完善,需要进一步深入研究与完善。在我国《宪法》和《体育法》中,对于公民体育权利未作详细的规定。公民体育权利是一项推进社会公平权、文化权以及经济权等等以公民身体健康为基础的权利。体育权利主要体现为法律法规中的人权,其延伸的含义却不能包含在人权之内,所以应当完善我国相关法律与制度,对公民的体育权利以及与体育有关的权益予以更全面的保障。With the progress of the times and the continuous improvement of the legal system,China has gradually introduced the research topic of citizen sports rights into the key research topic of law.Internationally,the right of citizens to sports has only been put forward in recent decades.Therefore,the research on the protection and enforcement of citizens'sports rights is not perfect,which needs further in-depth study and improvement.In China's constitution and sports law,there are some limitations in the provisions of citizens'sports rights,and no detailed provisions have been made.Citizen's sports right is a right based on citizen's health to promote social equity,cultural rights and economic rights.Sports right is a form of legal expression of human rights,its extension is much smaller than human rights,so we should improve the relevant laws and systems of our country,and give more comprehensive protection to citizens'sports rights and sports related rights and interests.
