摘　　要：因猎捕、交易、运输、食用野生动物而适用"加重处罚"的,需着重关注"加重处罚"的内涵及其与刑法基本原则的妥善对接与融合;在具体确立"加重处罚"适用的犯罪范围时,当关注野生动物保护法益的转型——以保护野生动物生物安全与生态安全双重法益为加重打击的核心;而对"加重处罚"中"上一格"的判断,可参考适用一个更为复杂、精细化的评判标准,将宏观视角下形成的"刑罚阶梯"与微观视角下形成的"量刑档次""刑种递变"问题进行适度的融合。If aggravated punishment is applied because of hunting,trading,transporting and eating wild animals,more attention should be paid to its connotation and proper connection and integration with the basic principles of criminal law.When the scope of crime applicable to aggravated punishment is established,the transformation of the benefits of wildlife protection law should focus on the dual legal benefits of protecting wildlife biosafety and ecological security.For the judgment of the upper case in the aggravated punishment,a more complex and refined judgment standard can be applied for reference,and the grading of the punishment class formed from the macroscopic perspective and the grading of the punishment class formed from the microscopic perspective can be moderately integrated.
