摘　　要：本文由分析医疗新技术临床试验期间的案例讨论,在尚无法定的诊疗规范可供专门的鉴定机构或法庭参考时如何评价该试验中各方的诊疗权利与义务,进而总结该案例中常见的关键裁判规则。By analyzing the cases during clinical trials of new medical technologies,this paper discusses how to evaluate the rights and obligations of each party in the trial when there is no legal diagnosis and treatment standard available for reference by specialized evaluation institutions or courts,and then summarizes the common key judgment rules in this case.
