摘 要:2019年颁布的《关于审理生态环境损害赔偿案件的若干规定(试行)》正式确立了生态损害赔偿磋商协议的司法确认制度,但由于条文规定过于原则,未对司法确认程序进行细化,将导致制度不具操作性。故应在现行民事司法确认制度的基础上,根据磋商协议的特点对司法确认程序进行细化。当事人申请确认应提交磋商协议、环境损害调查评估报告、损害事实认定证据等重要材料;法院应对协议的合法性、自愿性、可执行性等进行实质审查;并在30日期限内予以审结,有特殊情况可申请延长;法院对协议不予确认时,赔偿权利人应直接向法院提起生态环境赔偿诉讼。The Provisions on The Trial of Ecological And Environmental Damage Compensation Cases(Trial)promulgated in 2019 officially established the judicial confirmation system of the consultation agreement on compensation for ecological damage.However,the provisions are too principled and the judicial confirmation procedure is not detailed,causing the system not operational.So we should,on the basis of current civil judicial confirmation system and according to the characteristics of the consultative agreement,refine the judicial confirmation process.The parties must submit important materials such as consultation agreement,environmental damage investigation and assessment report when applying for confirmation;The court should conduct a substantive review to examine the legality,voluntary,and enforceability of the agreement;It should be concluded within 30 days,but may be extended under special circumstances;If the court does not confirm the agreement,the compensation holder shall directly take the ecological environmental compensation case to the court.
