台湾“公投修法”的主要特征及其对两岸关系的影响

摘　　要："公民投票"被看作直接民主的表现形式之一,但在实践中仍有局限和不足。民进党当局自2003年通过"公投法"、2004年操控通过"公投入宪"后,2017年、2019年两次推动"公投修法",其弊端在台湾社会持续放大,包括低投票率、降低行政效率、社会矛盾加剧、政党操控议题进行选举营销等,加之"泛台独公投"、"类主权公投"等涉两岸议题刻意制造对立,严重阻碍了两岸关系和平发展。当前,民进党当局罔顾民意,沿着"公投修法"到"修宪台独"老路行走,一方面关闭两岸和平协商、阻碍签署两岸和平协议,另一方面则是持续推进"法理台独"。The "referendum" is regarded as a manifestation of direct democracy, but in practice it still has limitations and deficiencies. Since the DPP authorities passed the "referendum act" in 2003 and passed the "referendum for the constitution" by manipulation in 2004, they have promoted the "legislative amendment through referendum" twice in 2017 and 2019. The negative effects of the referendum have continued to intensify in Taiwan Residents society, including low voting rates, reduced administrative efficiency, increased social conflict, political party’s manipulation of agenda for election marketing, etc. Along with cross-Strait issues such as "pan-Taiwan independence referendum" and "quasi-sovereignty referendum" which deliberately create confrontations, these events have seriously hindered the peaceful development of cross-Strait relations. At present, the DPP authorities are disregarding the public opinion and are walking along the old road which moves from "referendum amendment" to "Taiwan independence through constitutional amendment". They have closed cross-Strait peace consultations and hindered the signing of peace agreements, and subsequently have also continued to promote "de jure independence".
