我国数字作品“通知-删除”规则重构

摘　　要：“通知-删除”规则被确立为打击数字作品侵权的重要标准,对维护数字作品人的合法权益发挥着重要作用。我们应当在新颁布的《民法典》等法律基础上,借鉴美国DMCA“避风港原则”的相关规定,通过修改《著作权法》来明确规定合格通知与反通知的内容、网络服务提供者应承担的义务、错误通知责任追究机制、增设适用“通知-删除”规则的期限限制等条款,重构“通知-删除”规则,满足网络时代数字作品的传播和利用的需要。The“notice-deletion”rule are established as an important standard to crack down on the infringement of digital works,which plays an important role in safeguarding the legitimate rights and interests of digital works owners.Based on The Civil Code newly promulgated and other laws,using the relevant provisions of DMCA s“safe harbors principle”for reference,we should clearly specify the content of qualified notice and counter notice,the obligations of network service providers and the accountability mechanism of false notice by amending The Copyright Law.Besides,we should add some terms of time limit for application of the notice-deletion rule and reconstruct the notice-deletion rule so as to meet the needs of the dissemination and utilization of digital works in the network era.
