我国环境污染责任保险的赔付范围辩析

摘　　要：一方面,精神损害、间接损失以及生态环境损害属于被保险人承担的环境污染民事责任范围,但其是否包含纯粹经济损失还存在争议。另一方面,具体衡量被保险人承担的环境污染民事责任是否都属于环境污染责任保险的赔付范围,对于纯粹经济损失以不赔付为原则,以赔付有形财产使用功能丧失时的纯粹经济损失为例外;只有极少数国家将生态环境损害纳入保险赔付范围;对自有财产清理费用赔付以第三人或者公众利益为限。On the one hand,the scope of civil liability for environmental pollution undertaken by the insured includes mental damage,indirect loss and ecological environmental damage,but it is still disputed whether it includes pure economic loss.On the other hand,whether the civil liability for environmental pollution undertaken by the insured belongs to the compensation scope of environmental pollution liability insurance shall be specifically measured.Pure economic loss is based on the principle of non-compensation,with the exception of pure economic loss compensation when the use of tangible property is lost.For ecological environmental damage,only a few countries include it in the scope of insurance compensation.The compensation for the clean-up costs of own sites is limited to the interest of the third party or the public.
